ESA - APPEAL - WIN !! - now in Support Group was created by lochlisa
hello everyone,
good news, after a year of battling I am finally in the Support Group and the tribunal detailed the descriptors they found applicable and threw out the ATOS medical report as unreliable !
At long last justice is done.
Keep fighting everyone and don't let them get away with it. Thanks to this fantastic site I battled on and on and got there in the end.
All I am waiting on now is the next ESA50 and for it all to start all over again !!

go on your own.What was the basis on which ATOS report was thrown out.Did you attend
medical which iam sure you did where did atos fail you.Subject of interest to me

I had representation from a Legal Advice Centre who were brilliant.
The ATOS 'medical' was carried out at home as my GP confirmed I would be unable to attend a medical at a centre.
The ATOS report said I could run up and down stairs, go out and about freely, etc, etc, etc, whereas my GP's report was totally opposite and used some fairly strong medical language detailing exactly the issues.
The DWP ignored by GP's report and instead preferred the ATOS report (of course) and I was awarded 0 points.
The panel said they found the ATOS report unreliable and preferred the report from my GP.
I was awarded 15 points almost immediately and then the panel went on to detail a descriptor for support group that was obvious from the evidence provided.
Somebody needs to realise the mess ATOS are making of these procedures and the inaccurate reports that are being provided.
I will be sending the Tribunal outcome to my MP asking him to take this further.
