Hi i won my ib appeal yesterday and was given my 15 points as my new condition of arthritis was not applicable to my ib appeal, i have been claiming esa at a reduced rate since failing my medical due to my new diagnoses. i am having to send in med certificates and haven't filled in my new esa50 form yet. i was told to do nothing by tribunal does mean i don't have to send in med cert or fill form in now, so confused, as i'm supposed to be going for another medical after returning form esa50. does anyone know whats the best thing to do as esa took 9 weeks to sort my money because they were confused before my appeal!!
Hi,
Firstly congratulations on your successful appeal.
As you now have been awarded Incapacity Benefit (unless in the very very unlikely event the DWP appeal it on a point of law) your current ESA claim should cease. You will be paid any back Incpacity Benefit owed (less any ESA Assessment rate you have recevied in the meanwhile).
It could be an idea to ring the DWP BDC dealing with your claim, to ensure they have recevied the Tribunal service appeal result notice and start to pay you IB instead of ESA.
The ESA medical due should be cancelled as your ESA claim has been superceeded by your IB award - double check that the BDC are aware.

Hi pete, Thanks so much that has made my year, i am so happy it was an awful experience made easier by my best friend "AB" you know who you are, I was given my award notice it was only yesterday should i ring today or wait? Thanks again.
Hi,
It shows the vlaue of support by your friend if it made it easier for you at the tribunal.
To be honest I would ring today (even though they may not have received it yet) - no harm it telling them your news!. I would then ring next week to check on receipt of the TS appeal result and also enquire when your back pay maybe paid to you and ensuring there has been a smooth switch over between ESA to IB (as there should be).
