IB to ESA support group, no medical :) 1 question! was created by alzon
hi All. Just got the phone call and was told I am put into the support group without a medical. I have no doubt this is solely due to the guides on here as I have mental health issues, anxiety, depression etc.
I have a question though, which a quick google couldn't answer, but my head is still a bit swimming.
I am going to be on contributions based ESA the gent said. So if in 9-12-xyz months when I am reassesed, if I am put in the WRAG group, would I still get 12 months or would I just stop as I've been on CB ESA under the support group?

Congratulations on the award and thank you for your comments about the Guides.
If you have not previously spent any time in the WRAG then you will be entitled to the full 365 days if moved to there at a future appeal.
If you have previously been in the WRAG then this period will be deducted from the 365 days, so if you have already spent 365 days in the WRAG, then your payments of ESA(CB) would stop immediately.
You should check to see whether you are eligible for ESA(IR) as a top-up to your current ESA(CB) payments. If you are then your payments would continue even after the 365 days.
ESA(IR is dependant on your household income, assets and savings, and any hours that a partner works.
Asset rule for ESA(IR)
24 hour work rule for ESA(IR)

think my head has cleared enough for me to have found the answer myself, I hope! from the FAQ, surprisingly
"12 Month Limit for ESA(CB)
Entitlement to Contribution Based ESA will be limited to an aggregate total of 365 days in the Work Related Activity Group. The total is calculated as the sum of all the claimant’s periods in the WRAG, within a single claim. Periods in different claims do not count towards the total.
Claimants who have lost their entitlement to ESA(CB) and do not qualify for ESA(IR) but at some time meet the criteria for the Support Group will have their entitlement to ESA(CB) re-instated, providing they have continued to have Limited Capability for Work during the interim.
Time spent in the Support Group will not count towards the total."
assume I read that all correctly.
I should say thank you very much to this site, its disgusting that we are treated this way, its been a nightmare few years with the waiting but this site has provided the level of information and support to keep my head barely above water.
thanks to everyone and my thoughts go out to all my fellow folk still stuck in this nightmare, I know it wont be long till im back into the whole process, but for now at least, the cloud have lifted.
