ESA Support group with no WCA and DLA increased,

Thank you so much to Benefits and Works your guides are fantastic. My daughter has migrating from Incapacity Benefit to ESA and been placed straight into the support group without having a WCA, we are both so relieved. My daughter’s DLA benefit went from the lower rate care component to the middle rate care component after a change of circumstances. My daughter found your guides invaluable and used them to help her complete her ESA and DLA forms and we both want to express our gratitude to you for the wonderful work you do. It was well worth the money and we have recommended your website to many of our friends in the pain support group we belong to.

I do have one very important question to ask. After reading some of the posts on your forum I see that there is an ESA85A form you say we can request and this will give us a guideline to how long it will be before DWP/Atos will assess my daughter’s case again. My question though is if I phone up the DWP on behalf on my daughter is this form something that they will readily give as it is our right or can they be unhelpful in this matter and say they don’t have to send us this information? If this happens what are our rights regarding obtaining the ESA85A form? I await the response and guidance from your website experts on this matter.

However, the information included in the ESA85A regarding the prognosis of the award and which ESA Regulations were applied in gaining access to The SG can be rather vague.

Therefore, you may wish to make particular request for the above.

I'm still studying the post you've mentioned.

Regarding obtaining information and the ESA85A medical report, do you consider it is worth phoning DWP or would you recommend writing to them? It seems from the link to your post that the person didn't get much help when he/she tried to phone. Phoning is obviously quicker but I'm bemused by the whole process!

Regarding writing and sending in an SAR does the term prognosis refer to how long it will be before they assess your case again? If so is this what needs to be written on the SAR so they send the correct information? Sorry if this is something you've already answered but it is all a bit of a minefield of information to work out. Also can you advise me how to find my nearest benefit office and if it is the job centre or somewhere different?

On the SAR you can tick computer records and clerical records, what is the difference between them and which one is needed to tick or can you tick them both to get the information required?

Some people have received the above by making a phone call, others have not, so I am afraid it is "Pot Luck"

You could request it over the phone, and then back it up with a written request (SAR) to be sure.

Yes it does, the prognosis is the recommended length of the ESA award before you are reassessed.

You should address it to the Benefits Office/ Center on the ESA SG Award Decision Notice letter.

Computer Records will be classed as electronic, Clerical will be "hard copy".

You can request both.

You can make specific written requests for The Prognosis, and The ESA Regulations that were applied in placing your daughter into The SG.

Further, to cover all bases, you can request "All" Documentation, electronic or hard copy that was used in your daughter's ESA WCA process.
