I have spoken to my MP's office about this, and they say the problem is that civil servants are not telling ministers about the problems, but if that is the case how can we mere mortals do anything.
I am now going to put my complaint in writing to my MP stating that if they cannot get the DWP to look at the 2 year decision again then she shuold write direct to the minister concerned explaining why the tribunals are making these reccommendations.
I will keep you up to date if and when i hear anything.

Hi cm,

You could contact The TS, to kick up a fuss.

However, I don't know whether this would help, it would certainly do no harm.

I doubt that they would be able to actually change anything - but I do think they should know that their recommendations are being disregarded like this. Hopefully it will make them very angry :evil:

Further to my post in March, I wrote to DWP to confirm when my next assessment would be bearing in mind that the Tribunal recommended on March 1st that I was not retested for 2 years. This is the reply I received.
"With regard to your enquiry concerning the Tribunals recommendation of 2 years, I have checked the guidance on this matter. When an appeal is won, as was your case, the decision maker can decide to accept the Tribunals recommendation for the period of reassessment. It Is not binding. In yuor particular case they accepted the recommendation and as the legislation states they calculated 2 years from the original date of June 2011, when the decision was made to place you in the Work related activity group".
Therefore they have decided to retest me this year and not 2Years from date of hearing which would have been 2015.
