Thank you chrissy; sorry to hear that, I realise how fortunate I am not to be having to deal with that level of stress.
This process (I refuse to call it a 'journey') is so unpredictable it defies any sense.
All the best,
hopi

I'm interested that you say the ESA85A will confirm what descriptors were met. I posted a few days ago to ask about these ESA85A forms because my son's just lists all the descriptors which the ATOS nurse asserts don't apply (i.e. all of them). Puzzled!

I did say "should" :)

Most ESA85(A)'s give some understanding of the descriptors the ATOS "doctor" believes you meet, but not all, also the DWP Decision Maker is not bound to accept the ATOS recommendation if they disagree with it.

There may be an ESA72, this is a new report, and we are still not sure on what basis it is being completed, failing that you can try making a Subject Access Request for all of the information used in the making of the DEcision, although even then you may still be none the wiser.

SARs to the DWP are covered in the guide on the following link

I thouhgt this may be of interest.

My husband was given S/G status. I requested ESA85 and all relevant info used to make this decision about 8 weeks ago.

This morning recieved ESA85(one page),under heading of Advice, states, I advise that the client S/G criteria as they have severe functional disability.

Under headig of Prognosis, states, return to work is unlikely in the longer term.

Under Justification of Advise, states 4 lines of reasons.

There was no mention of points.
With the ESA85A was an ESA72 stating he will be assessed in July 2014.

I am not sure which criteria he has met for S/G status.

Radhika.

Many thanks. We've already done a subject access request - nearly 60 days ago now - but as you say we may be none the wiser even if we ever get a reply. We also asked for a written explanation of reasons back in early Sept. All we've had in response so far is the ESA85A form - no covering letter or anything, so I don't know if that's in response to the SAR or the request for reasons!
I've phoned and been told his appeal/reconsideration was being transferred from Edinburgh (address on decision letter) to Carlisle (his nearest BC)for fast tracking because after being invited for a WFI he was talking about killing himself. But Carlisle office has since shut, so papers were sent to Burnley. But it seems that office is also closing or possibly is sinking under the backlog of cases, so apparently Preston office will be dealing with it - once they get the paperwork. As we sent in lots of additional pages and supporting evidence, I'm just not confident the whole bundle will ever arrive intact on the desk of someone who is prepared to read it!! I'll keep you posted if we ever get a result.
