Yes S,

You should receive any backpay owed from the time of the adverse fit for work decision to when they start paying you the correct rate of ESA in The WRAG, as you will now be classed as having been in The WRAG since the date of the adverse fit for work decision.

Again, with Transitional Protection you should receive no less if successfully transferred to ESA, than you did before the transfer, see : What will I be paid?

The £71.00 is the main phase, (as well as assessment rate of ESA) if you are then placed into the WRAG you would receive the main phase payment of ESA, plus the WRA Component, if you are placed into the SG you would receive, the main phase payment, plus the SG Component.

If there is no mention of the WRA Component in your letter, you need to query this, see :

ESA Rates 2012/13

So, WRAG = Main Phase ESA = £71 + WRA Component = £28.15.
Giving total paid as £99.15.

SG = Main Phase ESA = £71 + SG Component = £34.05.
Giving total paid as £105.05.

If any of these amount awarded where less than you were receiving before being transferred over to ESA, for what ever reason. you would also receive a "Transitional Addition" top up payment to bring you up to the pre transfer level.

Thought I'd read it right :)

The letter just quotes the £71 no mention of the WRA component. Dates seem a bit weird as well, states ' the amounts on this page apply from 14th april 2012 to 15 february 2013' - my payments where orginally reduced from 18th feb 2012 so surely that's the date they should backpay me from?

I know my payments will be slightly less than the 'standard' as I also have a small pension from work which they take into account. Actually reading the letter again I think they may have my miscalculated how much they take off my benefit each week as well - it seems quite high, I'm sure the amount they are quoting is what came off my fortnightly payment - off to check the allowance rates!

Just waiting for a call back from DWP and wanted to be sure I'd got the facts right before I started complaining to them ;)

Hi S,

I think this " the amounts on this page apply from 14th april 2012", is referring to the date that the current benefit rates, 2012/13, came into effect. The Feb 2013 date is probably for admin purposes only, with no real significance.

OR, thinking about it, The FEB 2013 date could be the date that your 365 day entitlement to CB ESA, runs out ?

Yes S, any backpay owed, should be paid from the date your IB ceased, which would be the same date as the fit for work decision(The adverse decision appealed) came into effect. So on the face of it, this could include a pre 14/04/12, 2012/13 increase amount of benefit from Feb 18th 2012 to April 14th 2012, and then the current benefit amount thereafter.
