When your 365 days of contributary benefit is ended your claim will become income-related. As you are already getting an ir 'top up' you should find that this happens OK. Other people who have another source of household income will find that their payments stop at this stage.

I'm in both income related and contribution based ESA so where does that leave me with the 365 daything?
The letter states payment dates also from aug.-nov.12 is this when they reveiw me?
I have Fibromyalgia that is my main condition but i also have another well too many to bore you with.

Hi CJ,
As part of your ESA is Income Related, you will not fall under the 365 day entitlement rule.
Therefore you will continue to receive your ESA for as long as you are entitled to Income Related ESA.
You most probably will still have to attend Work Focussed Interviews, (WFI's) though, although you can request that they are carried out over the phone, or ask that they are deferred, although you can not insist on either.

Regarding the November date, please see Mrs Hurtyback's comments re: this.
This November date appears on many claimant's award letters, and seems to be for admin purposes only.

The por man knows that I am going through hell with my ESA and I think that he thinks I know all the answers because of that!

I am afraid we don't deal with Pensions, so they will need to get face to face advice on this.
With regard to their claiming JSA, the eligibility rules are substantially the same as those for ESA, and of course, you have to actively seek work in order to receive payments.
