I just thought I would give an update on what has happened to me since my appeal was cancelled in August 11 (as I complained about my medical with ATOS and my complaint was upheld by ATOS, therefore I had not received a medical).
I received an ESA50 from ATOS to start all over again, and DWP confirmed I was only entitled to assessment phase of the benefit, even though I had Limited capability of work.
I was informed that once I had completed the ESA50 and medical assessment (if needed, which it was) if I was found to be entitled to ESA it would be backdated to March 11 (week 13).
I remained on the assessment phase for 50 weeks, and things were only speeded up when I sent a complaint to my MP and it was forwarded to ATOS and DWP. It went from you are on the list for a medical to sending me a date which was 4 days later.
As you can imagine I am in a bad way, and not sure if have had breakdown, but have been put on alot of medication to stop me attacking ATOS doctor. I managed to control myself most of the time, and had to lay on the couch as unable to stand/sit. The HCP spoke most to my wife as I was unable to answer as so angry, and the assessment was cut short by the HCP. No physical examination was completed.
The DWP called my wife the following day to inform her that I have been placed in the Support Group and how much the back benefit will be (this was only because of the complaint to my MP). It was a great relief, but feel this should not happen to anyone. I am considering complaining further, but not sure if my health can take much more.
