Some good news. Thanks to all the help and guidance the site has given me my husband has just won his appeal to the tribunal. He had 0 points changed to 18, 2 years after he was first deemed fit to work by ATOS in August 2009. It took one year to get to the first appeal stage when the judge decided that there were discrepencies in the medical but they had insufficient medical information to make a decision on the day and that we would be asked to return in about 6 weeeks time for a decision. In fact it has been over another year after that to get to this stage. Even the judge and doctor at the tribunal were shocked at the length of time he has had to wait for a decision. He has had mental health problems so you can all imagine the stress the last two years has put him through. I just would like to say to those of you out there with mental health problems who are wondering whether to appeal it can be worth the fight. Good luck to everyone else.
