Common sense is not part of the descriptors.

It will be Atos by means of an ESA113, but a change in procedure allows them to send this form after you have completed and returned the ESA50, and it is entirely discretionary as to whether the form is issued.

Previously prior to October 2008 under the old personal capability assessment for IB, the IB113 (the predecessor of the ESA113) was sent before the issue of form IB50 by the DWP on a mandatory basis depending on the claimant's medical condition, which in my opinion was a much more sensible approach in seeking information from a claimant's GP. However, since Atos assumed full control of the WCA common sense well and truly went out of the window in all respects!

That is interesting as my last IB50 was 2007, it was sent in and they called me for a medical, whole saga about them agreeing to postpone a few weeks due to member of family being in hospital and me having no-one to take me as a result and then they sent an appointment for following week anyway!!!! Wrote to them but before they got letter I had call to say I no longer needed to be seen for a medical, they had received further information, it was from my GP, so the IB113 had clearly not got back to them before they sent my IB50.

If the IB113 was returned late, not returned, or returned incomplete, the DWP in these circumstances would have been entitled to issue an IB50 to a claimant.

It may have been the case that the IB113 was received late following the issue of the IB50, and when the form was returned it contained enough information following medical scrutiny for you to satisfy the PCA?

Yes it could well have happened that way, the doctor I see is part time so I guess she might not get all her paperwork done as quick as others.
