Tribunal Tommorow was created by LolaDawodu
Hello All,
Im having my tribunal tomorrow and i have no idea as to what to expect. Ive read a couple posts and it seems like its a 50-50 chance it may/may not go well. My welfare adviser has written in my favour and thinks i should be awarded higher rate mobility but she will not be atending on the day. I will be taking a family memeber for support but im just VERY NERVOUS
I have sickle cell disease and ive spoken to quite a few people and it can go either way as every1 sickness is different. Just wanted to know if any other people on here have the same illness or any other last minute advice
Will be much appreciated, thanks x

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Tribunals are inquisitory rather than evidential, which means that the panel will be more interested in hearing how your illness affects you on a day to day basis, than anything that your GP or Consultants have written on your behalf, although this evidence will be read and considered as part of their deliberations.
The Tribunal panel is usually three people, although sometimes it can be two. A judge, a doctor and an independant person. The DWP are rarely represented at a Tribunal, so you probably won't have to worry about them.
Most of the questions will probably come from the doctor, but expect the others to ask you things as well. Just take your time, consider an answer and tell them, don't feel you have to rush, and if you need to explain something in detail, then do so.
You don't say what your Tribunal is for, but it be worth have a quick review of the relevant guides in the Members area if you have time. Make sure you have all of your papers with you and allow time to read them.
Finally, make sure you arrive in plenty of time as being late won't be viewed postively.
Good luck for tomorrow.

ESA tribunals have a two-member panel (judge and medical member) but DLA tribunals have three. The third member will have knowledge or experience of disability.
The DWP is very rarely represented at ESA hearings but I believe they usually are at DLA hearings.
The judge takes the lead in questioning but there is no set order of who speaks when. It's entirely up to the judge how the hearing is conducted.
