New ESA50 and Medical was created by jmoore
I have received a new medical appointment even before I have had a chance to send back the esa50 form that has been sent out exactly 4 months after wining an appeal. I am keen to know if I am failed again by the DWP will my payments be stopped while I undergo the appeal process again

Sorry James, but yes they will, although you will of course be eligible for the Assessment rate while you appeal.I have received a new medical appointment even before I have had a chance to send back the esa50 form that has been sent out exactly 4 months after wining an appeal. Is the date for the medical, after the date you are required to return the ESA50, as ATOS are supposed to review the form before carrying out the medical!

Yes the Medical has been set up before they have received back the form and I cannot see how they can do an assessment that quickly as I only just sent the form back on the 9th and a medical was setup for the 21st. Atos tell me that this is also normal. I don't really know. I would have thought they would have looked at my previous heart attacks and heart disease and now also with type 2 diabetes and severe depression. I feel the dilly dally last year and having to survive on £65 a week caused me to have a bad diet and I think resulted in the diabetes from all the stress. Do you think I have a case to make a complaint about how I am being treated. I had my first medical in March of 2010 another for DLA in November, the tribunal decision happened in February and by June they sent me out new forms and then the strange timing of the medical appointment.

I think that any complaint to Atos would be a waste of time, but a complaint to your constituency MP may be useful to highlight the complete and utter absurdity of repeat WCAs in such a short period of time, not because your condition has improved in the interim period, but because of the nuisance value to claimants and I believe an element of sour grapes for having the temerity to win your appeal!

Thank you for the advice. I will put in a complaint to my MP over the main points and how it is actually making my health worse not better by undergoing the stress.

Good luck with your complaint.
I can empathise with you suffering from severe depression, and I would have thought that it would be blindingly obvious to Atos that all the extra unnecessary stress associated with another WCA after such a short period of time, would only lead to a deterioration in a claimant's mental health and certainly not an improvement!
