Then was informed by Atos customer relations email that my ESA50 has been reviewed and now no longer need to attend foe 'medical'; that Papers were returned to local DWP office; with Atos' advice that one currently meets the Limited Capability for Work criteria.
Not sure yet of what this means. While now searching out Archive material I would appreciate any current comments ---especially about the implications of Atos acting in this manner.
Has anyone else had this experience?
I believe I was a real pain in the neck with about 20 communications in last month to Atos and demanding legislation and procedural propriety ----and sensibly keeping a 'paper' trail to present for appeal etc.
It is possible for ATOS, on reading your ESA50, to decide that you meet the criteria for the Work Related Activity Group or the Support Group without the need for a medical.
This has to be confirmed by a DWP Decision Maker, however they are unlikely to have a different view as they are not medically trained.
So it is likely that you will shortly recieve a Decision letter in your favor from the DWP.
