I'm sure someone will come along to help you further, but I would have thought you could still officially appeal this decision.

You do have a month following the date of a benefits decision to appeal on a form GL24, so I can see no other way in which an appeal could have been heard so quickly after a decision.

Is the appeal they refer to an ongoing appeal relating to your ESA?

Has the OP got both DLA and ESA claims on going ? both at different stages

Following a letter on Yesterday saying that I had failed my medical, I have received a letter saying that they have looked at my claim again following a recent change (don't know what that is) and my appeal has been heard by an independent appeal tribunal and they have confirmed the decision maker's opinion that I do not have Limited Capability for Work. As a result of this decision my ESA has ceased from 22 June 2011. I did hear via a phone call I made to them 2 weeks ago that I had failed my medical, and I had put a letter together with why I consider myself unfit for work.

I already had an appointment with my Doctor this evening, he was totally appauled that I failed my medical and said he will back me all the way. I was completely distressed and he said it was no wonder after receiving a letter like that, and was amazed that they see me fit for work when he has just signed me off for another 6 weeks!!!!
Still an appeal to face, but got my op on Thursday still to deal with. Totally fed up
What is happening to the genuine cases of ill people. Their "mistake" saying my money was going to stop as from 22nd June, was just that push that could have sent me over the edge, and I'm sure there are many who feel the same. No wonder mental health is on the increase!!!!!!!!
