please help what do i do now was created by sammi1966uk
i was awarded hrmc and hrcc dla in 2008 at appeal
renewal was due may this year sent it in they asked my gp for reports then sent out an atos doctor to visit me at home recieved a letter this morning saying i had been turned down for both componants what do i do now
i dont think i have the mental state of mind to go through a tribunal again
it says i have a month to appeal but at the moment i just want to give up i havn't got the energy to pursue
should i ask for the decision to be looked at again

Ask for copies of your doctors replies and the Atos report and take both to a local advice centre for further guidance

Hi Sammi,

You could ask for the decision to be looked at again, but without further evidence the chances of it being changed are small.

However, if you're struggling at the moment it would at least buy you some time before you need to lodge an appeal.

It would certainly also be worth doing as xfactor suggests, but you must ensure you don't miss any deadlines whilst waiting for documents to arrive.

Hi Sammi

Sorry to hear you lost both DLA components, it would appear the medical evidence was unsupportive. Ring DLA 08457 123456 with NI number ask for all papers to be sent to you, once you have them, you can decide if you can get further evidence to ask for a review, or go back to a tribunal, who awarded you in 2008.

Asking for the papers will give you an extra 2 weeks from the date of the original decison letter. As Steve says beware of deadlines. You might get help from CAB or DIAL who will read through the evidence to see if you have a case for appeal.

There may be an organisation with experience of your medical condition that can also assist you. As you won at appeal before I hope you will find the energy to pursue this and are successful.

ok its been a couple of days since i got the dreaded brown envelope saying that they had stoped my dla altogether and i'm now feeling very different to when it first came through, after reading up on it it seems that a high majority of people are in the same boat as me been on hrmc and hrcc and have been told that they are now miracaulosly cured of the need for help with every day costs that being disabled brings
looking at the reasons on the decision makers letter for refusing me dla i have decided to fight it and go to tribunal i dont know where i am going to get the strengh mentally or physicaly but i feel that i need to fight for what i believe i am rightfully entitled to
any help or advise will be gratefully accepted
i just hope it will not all get to much for me i know i am going to have a long hard battle but i feel that if i go to tribunal at least i will get to put my case to an appeal panal and not just rely on an atos doctor who was being handsomely paid for visiting me for half an hour and deciding that i dont need help with care or mobilty needs anymore

Hi Sammi,

Download the guides to DLA appeals from the members area and they will take you step-by-step through the whole process.

If you begin collecting and preparing evidence now you should be able to pace yourself so that it's less likely to become overwhelming.

You could also try to see if you can get help from an advice agency.
