migration IB to ESA was created by DRAGON2009
I have been reading the Disability Alliance site concerning migration.

It suggests that if you succeed with the ESA test then you will be migrated.

However my understanding was that you would be migrated by automatic mechanism and THEN assessed

Here is what the Disability Alliance page said

"The effect of migration

If you are found to have a limited capability for work in this assessment, you will be moved (migrated) onto ESA but of those found fit for work the Government expects that:".....

This means that the review date (example January 2013 ) set on the IB file, would not be the migration date but the date at which the process begins,

I think the Disability Alliance page is wrong. Mugration applies from ther beginning of the assessment phase which is the point at which the process begins. The 'clock' for time limited contrib ESA begins with the assessment phase

Any clarification ?

I think DA is correct. As far as I'm aware there is no assessment phrase for IB claimants being moved to ESA. They remain on IB until a decision is made. If successful they then get moved to ESA.

Im trying to grasp what you are saying.

I am on Con/based inc/ben my migration date is March 2012.

If say i am sent an esa50 form in March 2012 and then attend a medical say June 2012 and pass medical for the W.R.G. from what date will my 12 month time limit for esa begin, will it be the date from when the esa50 form is sent(March 2012) or will it be from if/when i pass the medical.(June 2012)

The start date for your ESA would be from when you where awarded, from what I can gather that is the date of your face to face, if you have one. You would continue to be an IB recipient until that date, thus this would not count towards the 12 months entitlement, that's of course if the 12 months rule is passed as law.

If it is we should not forget that it will be retrospective, ie, time you are in receipt of Con/ESA before April 2012 will count towards the 12 month entitlement.

I'm not bold enough to give a definitive answer but this is what I believe to be correct.

First a decision would be make that you satisfy the WCA (after the face-to-face if you had one), then you get issued with a 'conversion' decision, and the effective date of conversion will be two to four weeks after being notified of the 'conversion' decision, depending on the day your IB/IS/SDA is paid.
