As Promised Results From Tribuneral Today.

We arrived at 1pm and Tribuneral started at just after, they were on time.
When we went in the judge introudced the panel, they were all very friendly and nice, we worried for nothing on that one...

They did both appeals at the same time it lasted 40 mins total.

My partner and I was asked questions and they were taking notes and the doctor was busy looking things up in a book over the comments we were making.
They were very rigid on sticking to two years ago, they acknowleged that my partner was in a poorer health and sympathised that they couldn't take this into consideration, which we knew anyway...
We waited only 5 mins for outcome and then were called back in...

My partner was awarded low rate DLA for care and ESA with support component until 2014.
I am guessing he will get back dated to 2009 as thats the date the judge listed on the notice for DLA.

We were hoping for the higher rate DLA but going back two years it's a fair award as his mobility was not as bad as now.
We may consider putting in a fresh claim for DLA but for now am happy to relax for a while knowing at least now it has been reconised that he is sick....

I should have added that my partner was awarded 18 points at the ATOS medical he only got 6 points.

Well done Tracey and thank you for coming back to let us know the outcome.
It really does encourage other members in a similar position to appeal.

The DLA will be back-dated to the date the Decision Maker refused the DLA claim.

Don't spend all the arrears they owe you at once ;)

Jim Thanks for your reply.
Do you know if the ESA is back-dated too?
My partner has been getting the basic rate for the last two years £64 were not sure if the top up amount is also due to be back-dated.
Thanks for any help you can give on this.

I'm sure my partner will be buying me a slap up meal for all the fighting I have had to do :-)
