I am going though the IB to ESA migration I have my medical on Tuesday, I am so worried that they will not listen to me, I intend on appealing if I have to, I don't want to claim JSA as I am not well enough to work, I know people who are making a fresh claim of ESA can stay on the assessment phase of ESA while they appeal, but what happens with IB claimants who are migrated if they need to appeal?
IB claimants have the same rights as new claimants for ESA, so if necessary you can appeal and you will receive the ESA Assessment rate while you wait for a hearing.
