I have ME/CFS and other health issues - last year i was subjected to an appeal - I attended and was awarded the Work related. This year i have had to appeal again, only this time my ME/CFS has made differences to my life - so my appeal was faxed to the department on the last day of the month for my appeal, directly from a job centre whom told me don't worry they have it.

today i gets my P45 and a letter explaining to me that i am no longer on benefits. I am sick and tired of this and i cannot guarantee an employer 100% of my time to work as each day my illness is different. I have good days and bad days.

So it looks like i am going to have to start the whole process again - as it seems they haven't taken my appeal forms into consideration on the last day of the month it was due. Unfortunately i was unable to get them in before hand due to health reasons.

HELP!

Hi Dorset-angel

Have I understood your post correctly, that you sent your GL24 notice of appeal on the day of the one month deadline, and JCP claim that it never arrived?

Also did you get a receipt?

It was done via Jobcentre to Jobcentre but they are still denying it as usual.

You may have problems claiming again within six months of the adverse decision unless your condition has deteriorated or you have a new condition.

However, there is nothing preventing you from submitting your GL24 late with a letter explaining why it is late. It would help if you can provide evidence that it was originally sent on time, such as a receipt, date and time it was sent, the Jobcentre and name of the person who sent it, etc.

They are now saying they received it - but they did not act on as requested via Jobcentre. Now i am being pestered for sick certificates to be backdated but this is, one, a waste of doctors time and, two, I have never known them to backdate - at the initial assessment i submitted certificates but i have not ever needed them, even when i won my first appeal did Ineed to send sick certificates. They said if i don't then my claim won't go ahead. Has anyone else had this as i certainly have not been on ESA for under 2 years?

I have just lost my temper on the telephone and they have curtailed my call by hanging up and saying this is what the government requires!

Because the DWP have found you Fit to Work, you now need your GP to say that you are not.

There is no reason why your GP cannot issue a backdated Fit Note.

This is really important, if you do not supply the Fit Notes, your claim will be closed.
