I can't get my head around ESA. I'm trying to understand the income based and contribution based aspects of ESA. IB was not a means-tested benefit but if I understand correctly ESA is going to be in 2012 so if someone has been in receipt of IB and/or migrated to ESA their benefit will be means-tested in 2012 and could be stopped immediately being retrospectively applied to the previous 12 months benefit? So if you've been retired from work through ill health and have no income except a small occupational medical pension but also are fortunate enough to have saved a little from the days when you were able to work, or own your home you probably won't be entitled to any ESA payment? Please could you tell me if I've got this right?

With all the changes it is not easy to figure out what is going on :)

When you are transferred you will be moved onto Contribution Based ESA. ESA(CB) is not means tested, although there are deductions for pensions, but the rules are the same as IB, so there will be no change from your current IB.

The Government plan to limit the receipt of ESA(CB) to one year for members of the ESA Work Relared Activity Group, but not the Support Group.

Whilst the one year restriction comes into force in April 2012, the year will not start until you are transferred to ESA, so you will have at least a year on ESA(CB), dependant on which group you put in.

After the year you will be eligible to claim Income Related ESA, this is a means tested benefit, so it is possible that due to your savings and income, you are no longer eligible or that payments are reduced dependant on your circumstances.

I thought IB was hard enough to figure out but this ESA is just impossible to understand for the average person. The whole thing is just too stressful.

Hi Gordon I understood when they say that you will move on to means tested ESA they take into account your partners income.

However what is the position if you are single living with parents. I am sure I saw somewhere where it stated that it will be family income of anything over £150 but unfortunately I do not remember where I saw it.

It is either a couple, married or not, a couple and dependants, or a single person.

If you are claiming and living with your parents, then their income is not included, nor would your income be included in any claim they might make (as you are not a dependant).

If your on income support on the grounds of disability will the transfer be for income related ESA not contribution based ESA
