dla tribunal was created by wissey
hi i am waiting for a tribunal for dla i applied sep 2010 and was refused since then in march 2011 i have been diagnosed with fibromyalgia and my condition in deteriorateing will they take this into account at tribunal or will it just be based on the osteoarthritis in knees and hips that i originally claimed for.

I think its based on as you where at the time you claimed

Dave is right, the tribunal will be looking at how you were when you applied for DLA. As your condition has now deteriorated, you should notify the DWP of this to see whether you would be entitled to DLA based on your new circumstances.

It amazes me that the tribuneral wont take into account a deterioration in health since the appeal, guess it's just another way of the government trying to hold on to their money.
My partner has his tribuneral next month and like you his health has deteriorated in the last 19 months that we have been waiting for the tribuneral.
Does reapplying for DLA affect the tribuneral and any back pay you may be due?

For most disability benefits if your health worsens following an adverse decision you can make a new claim while pursuing your appeal, and your new or deteriorated condition will be considered for the new claim.
