Return to work in 3 months was created by Electric
Hi all,
On my WCA medical report it stated that a return to work could be considered within 3months. Surely that's admitting I'm not fit for work. Is this just something they write for the hell of it? I only scored 6 points on the medical.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi Electric,
Just one of the many things on an ESA85 medical report that make little sense.
The health professional has to select one option from a drop down list stating when they expect there will be a significant improvement in your condition. In effect. this is a date when you should be examined again if the decision maker decides that you are not capable of work. Because, of course, in theory it is the decision maker and not the Atos health professional who makes that decision.

My ESA85 said 2 years plus, does that mean i will be left alone for at least 2 years? I am already a year on from the WCA.

Ah I see, there are obviously many other points on the WCA report that I don't agree with but just found that to be the most ridiculous. I am currently going through the assessment report and showing specifically which points should have been awarded. I have sent 2 long letters explaining the problems I have but it seems that writing anything outside of the descriptors is a pointless exercise. I never received and explanation as to their decision despite requesting one! It also says on the report that I could not touch my knees. From looking at the descriptors this alone scores 15 points. Unless I'm looking at the wrong info for the time period. Assessment was in January of this year. Thanks for your reply.

The Bending and Kneeling test test was relevant in January.

This could be relevant to any Appeal or Reconsideration that you might choose to pursue.Cannot bend to touch knees and straighten up again. 15 points
