DLA Appeal adjournment was created by pickles
just wondered if anyone advise me on if it might be possible to adjourn a DLA appeal with only a couple of days notice due to the fact that a representative can not make it on the day.

If it can not be postponed would a written submission be accepted instead?

Thanks in advance for any advice

Firstly, I wouldn't adjourn, it has probably taken months for your appeal to come to Tribunal, secondly, if you have a written submission then your half way there, it is best to turn up and face the panel, even being without representation, you have your bundle of which you can refer to, I didn't once need to look at mine since the questions being asked were straight forward,I didn't have anyone to represent me, although my submission was done by a CAB lawyer, it is said that even if you took your representative, you will still be the one the questions are put to, don't be phased by the prospect of going alone, take a friend with you, they can sit next to you for moral support, you may be surprised at how it goes!
Good luck, let us know how you get on :)

Hi Pickles

You can request an adjournment, and it may be a good idea if you feel you need your representative. Ultimately it's up to the tribunal whether to adjourn and there is no guarantee that you will get one.

I think with two days to go it would probably be too late to send in a written submission unless you turn up to the hearing to hand it in. But you can still hand in a submission of reasonable length before an oral hearing for the tribunal to read if you feel this would be easier.

Good luck

Derek

Don't forget, an oral hearing is better than a paper one, I was petrified of going alone without a representative, but telling the truth got me higher rate mobility & lower care, try not to be too nervous,I know how you're feeling today, I was the same a week ago, if you adjourn it may take months for another hearing to be put in place, but,you must do what you feel happier with!

HI, I have my appeal next month and have since found out maybe away on the date, when orginal letter sent months ago no appeal date was given just asked for dates not suitable.

Also my consultant wants specfic questions to answer to enable him/her to give supporting evedience. I have been told this is directed by the Judge? at the hearing so does this mean that there would be another hearing?
