ESA appeal

ESA appeal was created by Derek Grant
Received a peculiar phone call on Friday from DWP in Sunderland. They claimed that although i had requested not to be contacted by phone (as in your guide lines to my appeal submitted), they thought they would phone me to advise me that my appeal was being treated by them as lapsed(although it was submitted well within the time to appeal). They are going to place me in the support group and request me to undergo a further medical(presumably with Atos in 12 months time). I do not know wether to be pleased or very suspicious of their actions? have you heard of any other cases like this? What do you make of it? I have yet to receive any paperwork confirming these details. Will they reinstate the full amount of ESA i was receiving when it was taken away last November and will it be back dated, do you think? Your appeal has been lapsed because the DWP Decision Maker has found in your favour and placed in you in the Support Group.

Part of the Appeal process is for the DWP to carry out a Reconsideration of your evidence, obviously, when they did this they realised that your condition was worse than they first assessed.

Congratulations, and hopefully a least a year before you are re-assessed.
