Bobbie you don't simply need any old advice either, in my opinion you need a benefit specialist. I've heard that the DWP will charge you with everything they possibly can whether it's really relevant or not as the law is so complicated hardly anyone, judges included, really understand it and many will assume you're genuinely guilty just because you're being charged. This will make it look like they've caught some supervillain when you get convicted of all these charges and they can get press coverage and look efficient. You may have done something illegal, you may not, and even if you have arguably there might be extenuating circumstances in that you weren't claiming as much as you were entitled to - through ignorance - if you had been then you wouldn't have acted illegally even in ignorance. Kinda thing! Someone that really understands the relevant law could help you with this.

Hi Bobbie

Tribunals deal with Social Security law, which includes overpayments whereas fraud cases are often dealt with at a Magistrate's court (you didn't say what you have been charged with). As none of us have any expertise in criminal law or fraud cases I'm afraid your question is beyond the remit of this forum.

I can imagine a situation where somebody is cleared of any wrong doing in court but the question of overpayment could still remain, with the potential to have to appeal to a tribunal. Your lawyer may be able to advise you on this.
