DLA and ESA both won after reconsideration

Just to give you folks a bit more heart about fighting for your rights, my husband has been awarded both hrc and hm DLA and been put in the support group for ESA both from asking for a reconsideration.

Without the help and support of this forum and you lovely people I wouldn't have known how to go about this. I tried to get the help of a WR officer but they have all been made redundant in our area so had no choice but to go it alone so to speak.

The previous decision re ESA was based solely upon only one of his illnesses when he has many. With the help of a Drs letter and support nurses letter and lots of extra points made by myself questioning their decisions, we got the result he should have had in the first place. The DLA was obtained with a similar approach.

I also contacted our MP but I don't think they did anything as I have only had an acknowledgement from them but I did mention in the ESA reconsideration letter that I was doing this.

The only drawback is they are going to assess him again at the end of the year. I queried this and was told it is normal to do this once every 6 to 12 months.

Hi, well done for fighting the decisions and congratulations on the results!

Fingers crossed, they will be too busy with the 'migration' to put your husband through the mill again so soon.

Well Done !!!

If you wanted to push the issue, you could challenge as to why they havn't awarded the maximum review period of what I think is 2 years.

If his condition is irreversible, etc, therefore no likelyhood of being able to work in foreseeable future.

However you have done fantastic anyway.

Thank you both. I was going to write to the appeals writer and thank her anyway so will ask that question. Again something I wouldn't have known about without this site.

Well done margaux and take a pat on the back.....

I have done a similar thing with my wifes DLA decision and contatced the DM after a decision without consideration of her full medical conditions.

Since then they have contacted her GP further and arranged a medical which she had last week. Now we await to see if the decision will be revised or we continue on to appeal but I have to say the DM we have spoken to has been sympathetic and she has actually done as I requested so I am happy about that and hopeful of a favourable decision.

My own situation is a whole lot different and I have my appeal on 3rd may after an 18 month struggle and wish I would have done something similar back then for myself.

Thank you John. I didn't post because of expecting praise but simply to say it isn't easy at all to get decisions overturned but hope is out there and it can be done.

I have spent many, many hours researching, reading and digesting posts/articles/guides on here and other forums/web pages before typing many pages of extra information both for the forms and reconsideraton letters.

I won't be leaving you all on here as I feel passionate about the disgraceful way the government are dealing with very vulnerable people. It's not just the effects on the disabled and long-term or newly ill either,it affects their spouses/partners too by the fact that most of them have to deal with all the paperwork amongst the many other changes to their lives.

Off now to think about and compose my next communication to my MP!
