WILL I GET ESA ? was created by Gumboots
I am at present on incapacity and ldb and am due to be reassessed for incapacity or now esa.my question is my husband works full time and we both have savings.i did work until becoming disabled after neuro surgery approx 6years ago. I am not familiar with means tested benefits and want to know will i still be entitled to esa? As i was to incapacitiy. Though i do have a funny feeling my sons university fees are about to go down the pan !!

When you are transferred to ESA you will receive Contribution Based ESA, which is not means tested, however, legislation likely to be introduced in the next month. will limit the receipt of ESA(CB) to one year for members of the WRAG, but not the Support Group. After this time claimants will be eligible for Income Related ESA, which is means tested.

The means test takes into account your assets, a maximum of £16,000 is allowed, and any income from you and your husband. In broad terms, if your husband earns more than £95/week after tax, then you are unlikely to pass the test.

Please could you clarify something for me? I currently receive IB, due for review this month. I can expect to be assessed for esa, but will this be for entitlement to esa, or to decide which group?
Also, will & when will the monies I reveive change from the IB to the esa assessment rate?

You will be assessed for entitlement and if successful which group you will be placed in.

I believe the government have waived the need for you to be paid at the assessment rate, so you will continue to receive your IB payments until a Decision is made.

So does this mean if you have been getting IB for years and you go for assessment for ESA and you have to appeal, the IB payment that you normally get will stay the same and not reduce to the assessment ESA rate?

That's a relief, but a person I know has gone on to appeal ESA and their money went from IB rate to the lesser ESA assessment rate. It also looks like months before their appeal will be heard and they are getting the £65 lower rate.

Do you have anything written to say the government have waived it?

the way i read it if your on ib and are moving to esa and fail, if you appeal you go to lower rate esa if you win and you old ib rate is higher than esa you then get paid that amount
