My DLA was reduced many months ago from higher rate mobility and middle rate care to lowest rate care ONLY!! My mobility by then was worse if anything. I spent hours on my appeal; they ignored much of what I had put on my forms. I sent further evidence as it became available. Out of the blue I then received a letter stating that they were giving me higher rate mobility and therefore had cancelled my appeal. I object to this as I believe I am entitled to higher rate care. I am now challenging this cancellation. has anyone else had this happen?
It doesn't stop you appealing, it's just that it's the new decision you need to appeal, not the old one. See it as giving you extra time to prepare your appeal.
However, do remember that if you appeal a decision, it can go either way, up or down.
