Can anyone help me with a lasy minute question, my husbands esa appeal is in the morning.
We have read the relevant esa reg.s leg etc, but are we right in thinking that if you are unfit for work on a particular day, say in the morning, would that deem you unfit for all of that day.
I don't think we could answer that question without more information. In general, the work capability assessment should look at how you are for the majority of the time, rather than being a snapshot on any particular day.
Good luck with the appeal,
Steve

It's ok Steve, a bit of last minute panic by me. I have managed to find the answer myself (in a contradiction on the medical assessors report of all places).
