im starting to wish id never put in an appeal. the thought of going to the hearing scares the life out of me :( i have palindromic arthris and my symptons come and go but are brought on by over doing things and stress. dont think i can do this how do i back out if i decide to? and could i get restricens put on jsa instead? gratfull 4 any help pls

Hi Nicky

Appeal hearings are often not as bad as anticipated. If you really don't want to attend, you can write to the tribunal and ask for a paper hearing instead. You will not have to attend this and would still have a chance on the paper evidence, provided you have submitted written evidence.

You are allowed to place reasonable restrictions on the kind of work and hours you can manage due to your health problems, but it can be a struggle agreeing the the JCP advisor.

thanxs dont think i can handle the wait its on my mind 24/7 and cause ive had a good few days now starting to doubt myself. how do i go about asking for a paper hearing? this is all new to me. thanxs again

Hi Nicky

Simply write to the Tribunals Service (the address will be on the letters) and inform then that you wish to switch to a paper hearing. You can explain why if you like although it is not mandatory.

It is important that you send any medical evidence that you want the tribunal to see, and any written evidence from you that you would like to say to the tribunal. There is more information in the appeal guide for the relevant benefit.

I do know just how you feel.I am still waiting for a date for my DLA appeal, but it really is worth going in person if you can.I have been to a DLA appeal before when I first applied 6 yrs ago and although you feel terrified the people doing the tribunal will know this & they do try to put you at ease. Remember they are not the DWP.You can get through it,just think its only 30 minutes and the decision could affect your life for years.
