I don't know what is industry injury medical ? I suffered work-related stress caused depression, can my depression and its related sickness such as back sore also belong to industry injury? my case is in employment tribunal now. Today I turned up in ESA medical but they let me re-book it.my solicitor used to ask for private medical assessment for tribunal,my employer has refused.

Following on from my Industrial Injury Disablement Benefit medical last week..........

Had a letter today to say that they are taking it away completely. (40% which was increased from 30% on appeal two years ago)

This has been in payment since 1982 when I seriously injured my back at work and have needed 5 operations on it since.
Plus I'm having a 3 level neck-spine fusion next month which is as a result of the damage to the lumbar spine.

PLUS I have permanent bowel damage caused by the third spinal operation (accepted at the appeal)

PLUS I have to have both knee joints replaced which is as a result of the nerve damage to my leg muscles caused by the same operation.
The examining doctor was supplied by me with all the hospital letters and reports and what has been dne to me is nothing more than persecution by someone who is after a bonus.

Even the DWP clerk apologised this afternoon when he saw what had been done even though it wasn't in his power to do anything about it.

So now I'm being sent this 'doctor's' report with an appeal form which I'm taking to the Citizens Advice Bureau on Monday morning.

The worst part is that I shall be without this benefit whilst I wait months and months for the appeal.

I've read about this callous treatment in the national papers.
Now it's happened to me.

So Sorry for your predicament Limasierra, What is their reasoning behind this?
Obviously you will appeal, good luck.
I have an industrial injuries tribunal coming up (possibly June) and really can't wait, it is such a shame that it takes so long.

Many thanks for replying!
I rang the DWP this morning and a lot of very important medical evidence I gave to the ATOS 'doctor' in written form (she only allowed me to answer her very specific questions) has been totally disregarded.
I have Cauda Equina Syndrome.

This is devastating and permanent nerve damage to the lower spine causing bowel problems leg weakness and a host of other things.
One of the letters given to the ATOS 'doctor' was from my spinal consultant stating that I have Cauda Equina Syndrome resulting from the initial spinal injury.

But that has been totally disregarded as obviously has the report regarding the new knee joints required - severe bone on bone osteo arthritis resulting from damaged nerves to my leg muscles causing my kneecaps to permanently be out of position.
So you see if the 'doctor' doesn't ask you about these conditions, even though you have supplied evidence from your consultants it will be totally disregarded if he/she decides to leave it out of the report.
The DWP decision makers won't bother to read the letters, they are office people who rubber stamp these doctors' reports.
The person deputising for the 'decision maker' this morning has told me that they have only looked at the 'back injury'.
I told her to look up Cauda Equina Syndrome.
She says she will pass this report to another 'decision maker' to be looked at again, but I was told yesterday by another DWP prson at that office that these decisions are rarely changed until it gets to a tribunal.
So I have to sweat it out for 6 or 7 months whilst coping with a newly diagnosed heart condition and 'try not to get stressed.
Difficult when there will be a big drop in income.
But I'm seeing my GP soon and I know he'll write a very supportive letter.

I wish there was more help around for Industrial Injury claimants.

I've now seen what this 'doctor' has written on my medical report.

The written evidence/report of a top Complex Spinal Surgeon at Guys Hospital noting that I suffered Cauda Equina damage at the time of the initial
back injury has been completely ignored.
Any doctor worth their salt should know about Cauda Equina and the irreversible and devasting damage caused by this syndrome.

The ATOS 'doctor' has said ' NO ' to the question ' Does the evidence listed in the B18 lead you to conclude that the accident/prescribed disease still result in a relevant loss of physical or mental faculty ?'

Does this government really intend that benefit should be taken away under these circumstances?
Or are they turning a blind eye to ATOS earning themselves thousands and thousands of pounds in incentive bonuses by causing such stress and misery?

So there we are. What do surgeons working at flagship hospitals know compared to an ATOS doctor??
