hi my hubbys appeal is coming up hopefully before spring he had dla stopped due to his idiot of a gp filling in the report for him when we challenged him over this his reply was that dla it the new allowance thats just for people in wheelchairs he is so wrong he is going off the old mobilty allowance how can we sort this at an appeal my hubby has had a deteration in his health since the appeal was sent in which was put in writting to them even though dwp didnt change the descion its still going threw the appeal he has epilepsy, depression and physical disabilitys its been almost a year since dla was stopped he is now on extra medication for epilepsy, new anti depressents , for severe depression which makes him feel sucidal , and also physical disabilitys he also has a new doctor any advise would be appreciated thanks x
Unfortunately the Tribunal can only consider evidence and your husbands condition at the time of rge original Decision, any deterioation of his condition that has occurred since then will be disregarded.
You could ask your new doctor to write an opinion on what your husbands condition was or ask for a copy of his notes from the surgery, the latter may hold more weight, but it depends on what your relation with this new doctor is like.
I am no a DLA expert, but I believe as a year has elapsed that yould be entitled to submit a new claim for DLA. The fact that you are appealing a previous application would not prevent this.
