Hi, No doubt these two questions have come up previously (I have done some searching but unable to find question/answer). My daughter has recently (4 weeks ago) been awarded DLA low rate care at appeal but since then she has heard nothing from DLA about her award. I don't know how long she should expect to wait until she hears from them? Second question:- her award has been allowed from the date of the appeal, is this correct or should it be from the date of the original claim? Many thanks for any help on these points.
4 weeks is not at all unusual, I'm afraid. It's worth sending the DWP a copy of the short decision notice from the tribunal - they may not have even had a copy yet.
A tribunal can only look at how things were at the date of the decision, so it would not be lawful for them to make an award from the date of the appeal. If this is what they have done it sounds like an accidental error and you would need to contact the clerk to the tribunal about it.
