Confused about IB/ESA/Means testing was created by Marie22
Sorry if I'm sounding a bit slow on this but I'm still confused even though I have read your ESA guides. I have been on IB for the last 15yrs. When I get moved over to ESA I doubt I will be in the support group but likely the one below. Am I right in thinking that if/when I am that this benefit will be paid to me for only a year & thereafter will be means-tested, which as my husband works full time will mean no benefit ? Would appreciate some clarification, thanks.

That's pretty much it I am afraid.

IB claimants who are successfully transferred to ESA, will initially receive ESA(CB) and will be placed in the WRAG (most) it the Support Group (a few). Those in the WRAG will have there ESA(CB) limited to a year, from the date of transfer, after which they will be eligible for ESA(IR), which is means tested.

Thanks for your reply, I was afraid that would be the answer. Any idea when this is to come into force & is there any chance of a change of Government in the meantime, or is that just wishful thinking. There are going to be so many people worse off. Between that , child benefit, tax credits & university fees it's going to impact on so many border line families.

Hi - I apologise, I have had a look at the members IB advice & now have a clearer picture of time scales - not a prety picture either. I do hear people saying they believe this Government won't last, but even if they didn't it seems unlikely these changes won't proceed.

I'm in a similar position receiving IB and occupational pension (from 1998). I understand time limiting ESA CB in the WRAG group but will I also, within that year, be penalised for having an occupational pension (at the moment I'm not) I understand I will get nothing under eligibility for ESA IR. A year's grace would be better than nothing!

The necessary legislation is expected to be in place to start at the beginning of April.

Assuming you receive ESA(CB) when you are transferred, then there is an £85/week disregard for pension income, above this figure, half the excess is deducted. So if you pension is £100, the exvess is £15.00 and the deduction will be £7.50.
