Dla appeal decision to be posted to me was created by nicky
Hi not sure if this has happened to anyone else i appied for dla for the first time in october 2009 and was refused both care and mobility.I have attended an appeal today i had an atos doctor assesment that stated my balance was normal although i was attending a hospital rehab physio to improve my balance at that time i no longer attend as my condition has progressed so much that he cant help me.The appeal said they would post thier decsion i am worried as they kept asking about how i was over a year ago which is hard when you are in pain constatley also the atos doctor stated my condition would not get worse it clearly has.I am worried they just didnt want to say no to my face.

They ask about the past, because they can only make their decision in relation to how you were when the original decision was made. If your condition has worsened, you need to inform the DWP so they can reassess your needs from now on.

Hi Nicky
There are two main reasons why a Judge may give a decision through the post.
The most common reason is that they need time to consider their decision, particularly if there is a lot of evidence or complexity in the case.
Another less common reason is that the Judge may feel intimidated by the appellant and fear getting beaten up if the decision is adverse.
I hope you receive a positive outcome.

Thank you so much for your replies.I do have a complex condition i suffer from more than one form of arthritis also a conective tissue disease and have 4 mortons nuromas in my feet.since applying in october 2009 my condition has got worse i now have no reflexes in both legs due to crippling back pain and very low reflexes in both arms due to my neck pain also the usual pain in joints from arthritis.Please excuse spelling i am on morphine patches and brain has run off and left me lol.

Great news i have won the appeal got the letter today from appeal on monday.I have been awarded low rate care and higher rate mobility for an indefinate period.Also it will be backdated to 29/10/2009.I am over the moon to say the least it has been a long hard struggle.I hope i wont have to go through it all again in the near future.So i hope this gives other some comfort that it is worth fighting for.
