my friend has been refused care component of dla she has cronic mental health problems,her husband was made her appointee by the dwp, they sent someone to the house to determine wether or not she needed a appointee,it was agreed that she was unable to mannage her own affairs. so my point is that as the dwp have agreed that she is not capable why have they refused to reconise this and refused her dla ?? i am sure that i read in the dm guide that haveing an appointee would qualify a claiment to the care component
do any of you good guys out there have any ideas on this.

I'm trying to think of an example where having an appointee wouldn't necessarily mean you couldn't carry out bodily functions. Perhaps you might have someone with learning difficulties who could look after themselves in terms of bodily functions but couldn't make wise decisions with money?
However, if your friend were to appeal, the fact of her needing an appointee would surely be a useful factor to bring up, but if it were me, I'd be trying to get stronger evidence, maybe from doctors, key workers, support workers etc.

an appointee is someone to manage and help, they can talk to the DWP on behalf of someone, but they have not taken over
they can help for many reasons, some people just dont like talking on the phone or dont speak english that well for many reasons.
the role is very limited
also there has not been any medical and the person making the decsion to allow someone to be an appointee is not medical,

i understand what you are saying but i think what has upset them is that on the dla claim he explained that due to mental incapacity she is not capable of rational thinking and that if she had no help she would not go and collect her monney,pay any bills or respond to any letters, if she was left alone she would not even be able to cok for herself so i think the point he tried to put across was one of she would be in danger of harming her self through self neglect.
i know that thier is other facts involve with her disability aswell but i think he is desperate for the reconition of the care not just the money,
he hoped that the fact of her inability to carie out life without help would be enough to qualify for low rate care at leest. i have told him to subcribe to this site for help.
