I have had appointment today with a Benefits Advisor regarding my Tribunal hearing which will hopefully be in April 2011? i am currently receiving middle rate care allowance and have been told that the tribunal may well look at the care allowance and take that away depending on the evidence they have to prove that i need care. I am so upset as i really need this help, i recently had an operation on my spine with complications, i have been told that it can take anything upto 2 years to even know if the operation has benefited me in anyway at the moment it certainly doesn't seem to have helped at all, in fact i am worse now than ever. I require constant help with just about everything!it is really getting me down! :(
The advisor is going to arrange for me to have a representative with me for the hearing which im sure will be helpful but i feel that i have to prove how ill i am and how much life is a struggle it all seems so complicated. To have gone through major spinal surgery and then have to sit and almost prove to total strangers that your genuinely not coping and that you are struggling every single day i am just dreading the whole thing! any tips on how i get through the next 5 months whilst i await the tribunal? I would be very grateful if anyone else has been in this situation to get in touch it would be nice to hear from someone who understands how i'm feeling. thanks mummy of 2

Hi there, yes thats right, i'm currently receiving the care but keep getting knocked back for mobility and i can't understand why. I struggle to walk at all and have been this way for about 2 years i eventually took the plunge and had surgery as i just couldn't cope the way i was for another second, so much pain and discomfort but i have now been told it can take upto 2 years for everything to heal and settle down before i even know if the surgery has helped. At the moment it hasn't helped if any thing i feel worse. I had great expectations about having the surgery and getting better but that hasn't happened.

:( hi i to am having to go to appeal , i was on higher rate moblty, but its stoping in dec , iv sent letters,copys of letter from my doctor, copys repeat presction ect, i have asthma, angina, pulmonary hyption, depression, i have tryd to ring and talk to the dla, but they say this is just call centre and we dont have paper work here just reply to the letter so its very hard to try and get a reply from a person , and who the DESCTION MAKER IS WHO KNOWS I DONT, i have to reply to cap22 letter and as yet dont know wat to say , has to be in 14 days, but post is delayed due to snow, and xmas post we are not realy getting much , moan over with now , any help would be so so much help , :woohoo: :woohoo:

Hi Mummyof2, Can you not get supporting medical evidence from your consultant? If he/she could put in writing that you have these problems whist walking it may help with your claim. There is always a possibilty of your care element being looked at again but it does not follow that you will loose it. Just get as much supporting medical evidence as possible. Best Wishes
