Could someone clarify "care" and its relation to income support.If someone acts
for you as a carer and cares for you more than 40 hours per week. Is this not classified as working full time!!!!Is it not the same as a outside carer providing you with the same care. Is supervision a form of care.
Can it be argued that if it is your partner providing this care then she does not have to work as her partner is claiming IS for her.Would job centre be convinced if care chart given to them. In case they disagree what to do next?

It's possible for someone to get income support when being a carer. Usually what happens is that someone who is eligible for income support and carer's allowance claims income support plus a carer's premium on the income support, but we can't advise on your individual circumstances. Face-to-face advice from a welfare adviser could enable you to get a "better off calculation" to see which combinations of benefits are available to you and which would offer the best income.

Are you in receipt of DLA and if so, does your partner claim Carers Allowance.

sadly not! no more than being a stay at home full time parent is allowed to call what they do 'full time work'.

however, if it helps, i am on income support for the simple reason i am a full time carer for my disabled son whom i claim carers allowance for (because he is on high rate DLA care). i also get carers premium with my income support and am not expected to look for work.... even if i could.

when i last checked to be a carer/get carers allowance/premium in conjunction with income support you had to look after that person for a minimum of 35 hours per week.

to be considered for income support in conjunction with carers allowance/premium due to being unable to work due to being a full time carer, you should only need to show the DLA decision saying high rate entitlement to the care component (not sure if middle rate also entitles - i'm sure someone will correct me). obviously other rules apply to being eligible for income support

Yes I am in receipt of DLA but because i get LR Care i do not meet the criteria for CA. I already get IS for my partner but
my question is as regards to work focused
interview. Will Job Centre be convinced that as my partner is caring for me more than 40 hrs this is 40 hrs work is it not.
So if she works 40 hrs then she does not need to look for work!!!!!!!. :dry:

right, i'm with you now.

my personal answer would be, probably not, as low rate care assumes that you require only very limited help through the day

Lowest rate
You may get the lowest care rate of Disability Living Allowance if:

you need help with personal care for some of the day, or

your disability means that you cannot prepare a cooked
main meal.


it also assumes that if you had needs that require much more help 'frequently' throughout the day or night, then you would be on middle rate care and if the needs were frequent day and night, you would be on high rate DLA care.

to be honest, without a higher entitlement to DLA, i think it will be very difficult to prove you need 40+ hours help per week
