Hi Everyone,

I wondered if anyone can advise me regarding my epic ESA application! I had 2 medicals both failed. 1st one 0 pts
2nd 12 points and finally after an appeal by my CPN to the decision maker my claim was "Revised" and I received ESA Work related group for 12 mths.

Since then I have been trying to obtain the paperwork regarding the revision as I'm not sure why they changed minds etc and this information is very important when I next have a medical as I suffer from ME etc. I have phoned twice and written but since June when it was revised have heard nothing further but have received the back pay.

I wish to write to my MP as he helped me obtain a 2nd medical and I wanted to let him know the outcome as It was a very long drawn out stressful case. Could someone please advise what I can do to obtain the revision details and any others regarding my case as I just feel that I'm being ignored :(

I think you need to fill in a Subject Access Request. There is a guide on how to do this in the Other Benefits Info section of the Members Area (bottom of the page).

Hi

I'm afraid I can't help you but I was wondering if you could give me some information.

I have M.E and have had it since Dec 2008. At my medical I was given 6 points and appealed it. At the appeal (last Friday) I was given a further 6 points re walking but nothing else.

How did you get manage to get 2 medicals and what is a CPN?

I really do not know where to turn as to be able to claim JSA I have to be able to work 40 hrs a week, which as a fellow M.E. sufferer, I am sure you appreciate that this is just an impossibility.

At my appeal hearing, I even had medical evidence, by way of a report from an M.E. specialist stating that I have M.E. and that due to the fluctuating nature of the illness, unable to work. Yet this does not seem to have been taken into consideration at all.....What more can I do?!!

I hope you don't mind me contacting you and asking these questions.

I think most people, when they apply for ESA assume that it is their inabilities that the DWP are interested in, I know I did. Unfortunately that is why many, myself included, end up scoring no points from their medical.

The WCA medical is concerned with your capabilities, which is a completely different mind set. Furthermore, it is only interested in what you can do in a limited set of tests.

Have you looked at the ESA documents in the Members section, they explain the process, what the ATOS HCP is looking for and how to detail your responses on the ESA50 form.

You may look at the tests, the scores and how to respond, and think, this is stupid, you'll probably not find many here who would disagree. But this is how the process is carried out, to be successful, you have to fit in with it, bucking the process will simply mean you probably won;t score enough points.

Hi Debbie, Sorry to hear that you also suffer from ME and that you've been treated unfairly:(

You are not alone in the trouble you are having trying to pass the harsh WCA as I've read on these boards that many people with ME/CFS are in the same boat and its so unfair because as I'm sure you know that having ME restricts what and how much you can do at any given day.

A CPN is a Community Psychiatric Nurse who I was referred to after after becoming very unwell with depression and anxiety due to the stress of dealing with my health problems and the untold stress of dealing with 2 failed medicals. 1st medical was terrible, I was so tired and anxious and was dealt with by a Nurse in a really rude hostile manner which left me traumatised:( with advise from the CAB to appeal and to contact my MP which I did after I complained to Atos about my medical regarding nurses conduct and a report which was I believe fabricated with untruths so that I failed
with 0 points. my complaint was upheld and my MP contacted Atos to ask for a 2nd medical with a Doctor this time which I was granted. 2nd Medical I thought went well I took my CPN as a witness and for support. Doctor was polite said he understood all about ME and how badly it affected people and for me not to worry and then a week later I receive the decision that I have failed again with only 12 pts for anxiety and depression!!! shortly after all my benefits stopped, eviction notice followed! Appealed again and my CPN wrote to the decision maker and they revised the decision and put me in the Work related group for 12mths. Im trying to find out the details hence my post yesterday.
