Can anyone enlighten me, first medical with Athos last November, got zero points, appealed went to tribunal in May this year won my appeal with support group, under exceptional circumstances.Received another ESA 50 to fill in and attended a medical on 15th September, just received a letter from DWP informing me that i have been removed from support group to work related group?? How can they do that when you have written evidence from consultants and occupational therapist that a judge and doctor agree with. By the way it was a Nurse who carried out the medical? Has anyone had this done to them.

Hi Snadger
Sorry to hear you're being hassled again by the DWP.
The tribunal's decision will relate to last November, so the DWP will argue that your health has now improved, following the medical on 15th September. If this is not the case and you intend to appeal (again), make sure a copy of your previous medical report is in the appeal bundle. Bear in mind that there is a risk in appealing to get into the support group (see ESA appeal guide).
To answer your second question, Registered Nurses were approved to conduct PCA and WCA medical tests a couple of years ago. It shouldn't make much difference, a fully trained monkey would do just as good a job as any ATOS doctor.
Best of luck
Derek
