I have looked at the advice section on here regarding my question but I'm still unsure of the answer so I'm hoping maybe someone can help.

Last year I was awared DLA HMR & LCR, this runs out in May 2011. I have always felt that the LCR should have been at least middle rate, but, like many, I was afraid of losing my award. Now, as I am so much worse I am prepared to go for it. If the award is raised does it get back-dated to when my original award was made. I feel very strongly that my care needs were not considered properly on my application.

No, unfortunately, the award would not be backdated, unlike where you appeal. It would go from the date when you notified them of your higher needs.

I really should have done it at the very beginning but was too anxious about losing my mobility.

I totally understand you. I have had HMR with LCR for over 10years. I was awarded for life. Unfortunately the fear of asking for a review for extra care has been holding me back for more than 7 years. Because I also get Incap Ben, I have had around 5 reviews with some medicals.Reason for medicals were because I had Birth certificates held by local Ben Office as proof of my 2 children for more than 3 weeks,towhich they had lost. I complained and was duly sent for a medical. I also have had benefit officer in my home and speak to me unannounced as I lay in bed( had been unable to move for 2 weeks spinal condition)as he had threatened my wife that if certain forms of proof were not available by end of the day we may lose benefits.etc,,,,,
I sent in a DLA form asking for extra care in mid June 2010,was told it may take 11 weeks,and still after a few letters telling me it may take longer ,and then a couple of weeks ago into the 12th week I was sent another letter stating a report was needed from my GP,and possibly staff dealing with kidney /bladderfuntions at hospitals and the dif.units I have been to for the spinal problems .
I really get the feeling they will totally cut me off. I know in any other walk of life we would be appalled that thought, but living with any medical condition that gave us benefits in the UK should be aware that even a cut ,which means an individual having to appeal,saves them current money( good for stats),even if it may cost later(the gov) Unfortunately some of us may take the route they are hoping for.1 less on the polling list if you know what I mean.
