I have medical evidence that confirms my primary illness is in remission, (not cureable)Although i still have some symptoms. and am still having treatment.

Will this be taken into account in my medical because at present i am the best i have been for many years. They (DWP)already know this.

I am due another operation next month so i will be back unable to walk etc for a while. But i understand this may be irrelevant?
is it just the present that counts?

For which benefit/allowance are you having the medical examination?

I have a relapsing-remitting condition. I made that clear when I applied for DLA and I don't expect to have the same needs all year round, and the DWP doesn't expect me to, so it's just a question of ensuring the DWP has the whole picture, not just how you are on a better day or in a better month.

Having said that, the unknowable when you experience some sort of remission is how long it will last, but if it appears to become permanent at some stage, again you need to let them know.

So makes sure the DWP has all the evidence you can give them that will enable the Decision Maker to get a complete picture and see that your current improvement is not permanent so far as you are currently aware.

Survivor- many thanks.
I have been given conflicting/confusing information.
The DWP told me to re claim after my operation , although wait 3 months and will need to expect a recovery period of at least a further 6 months to re qualify. However CAB have told me this operation is treatment for my existing condition and not to re apply. They also told me my claim (that was disallowed) only refered to how i was at that time and future treatment although likely to make my condition flare up will not be taken into consideration.

I wouldn't contradict the advice you say you've been given. However, it is only part of the picture.

The CAB is right to say that your original claim only relates to how you were at the time of your claim, but if you appeal, you can bring evidence that would show that how you were on a particular day was not typical of how you were over a longer period of time, taking into account both past and future.

If you make a fresh claim, then yes, the time periods when you have had needs and will have needs are relevant, but again you can take into account the longer picture.

Having said that, this site does not give detailed advice on individual claims, only general answers, so we cannot advise you whether to appeal and/or make a fresh claim.
