DWP Loan.Person died.Does Death Cancel Debts??

Person was in receipt of a DMP LOAN but unfortunately DIED before it could all be RePaid.
Heard somewhere that Death expunges(Cancels)all debts of the deceased.Is this true?
They also owe a few £1000 to various tradesman for work done before their Death.
Can the family refuse to pay as the Bills and Commssioning were in The Dead Claiments name or could they come round and re possess the New Heating System?
And does Death cancel the debt???
Can they sue a Dead Person or Successor to get it out an estate?

This isn't anything I have knowledge about but I always believed that debts would be paid from the estate of the deceased, and I believe the estate could be sued.

I'm not sure where the DWP stand on this, but they seem to claw back money wherever they can!

When someone dies, any debts they leave are due out of their estate, but if there is not enough money to pay all of them, the beneficiaries of the estate (i.e. the people who get what the dead person left) don't have to pay the remaining part of the debts.

Someone who is owed money in this way could sue the estate if they thought it was worth their while. I do not know whether the DWP ever bothers to sue an estate.

I think you would be wise either to get some professional advice or to buy a book on what to do when someone dies. There are several available online and in bookshops that put it all in everyday English.

Firstly I am really sorry for your loss I have been there to. I have gone into this recently. I wanted to make a will so I got some advice. The executor(who's in charge of disposing assets of the will money goods and so on) if that's you deals with all debts and with the funeral expenses and the funeral expenses come before all debts. Then it's supposed to be creditors. Then the ones who were given things in the will by the deceased.

All of the creditors have a right to sue if it's in the terms of the contract as with credit cards. But most can sue for their money anyway from the estate. As someone else said nobody is going to sue for five hundred if it costs them a thousand to do so.


Your best bet Is don't tell them wait till they come to you. By that time hopefully you will have disposed of all their assets. Don't put large amounts money into the bank where it can be traced and you might have to show proof of where you got it from. Luxury goods can be thrown around the family and you can say the neighbors got it and took things it happens all the time.Good luck and god bless
