Hi. Well my appeal date has been set for the 17th of this month, having scored no points at the medical totally confused by decision. I suffer with Rheumatoidal Arthritis and Fibromyalgia i am somewhat confused about descriptors can any one help me out with my confusion.

Is it worth mentioning to the tribunal that i get the higher rate mobility and care at the hearing?

Hi Steve

You can find a detailed description of each descriptor in the ESA mental/physical health guides in the members' area. This will help you decide which descriptors apply to you.

There is also an ESA appeal guide which will advise you on approaching an appeal hearing.

I really dont envy your coming tribunal date but just wondered if you could get some supporting evidence from your GP or consultant and send this in advance.

Dont worry too much about not scoring any points as i only scored 9 points and now i am in the support group. Do you have a representative going with you?

Just out of curiosity, is your DLA due for renewal aswell or soon?

Hi Mm, No was awarded both the higher rates when it ran out in July up till then was getting higher rate mobility and lower rate care. Not sure about having some one with me yet lady from DIAL will look at my paperwork two days before but cannot represent me due to a massive workload. My fault or rather thr drugs fault for rendering me incapable of doing most things straight away.

Hi Steve,

Although ESA is a benefit paid to those unable to work due to incapacity to work, and DLA is paid to those with care and/or mobility needs, irrespective of ability to work, it seems to be a fairly common practice for DWP Decision Makers to look at DLA awards when looking at IB or ESA awards so be prepared for that.

You can seek help on representation from Community Legal Advice
