Hi if you lose your incapacity benefit(CB) after 6 years would you have earned enough ni contrtibutions while on Ib to get jsa for 6 months on contribution based or would you only be entitled to income based

If it's a direct transfer to JSA from IB that you are referring to then your claim will still be based on the same tax years that saw you awarded IB (CB). So you would be entitled to ESA (CB).

However, note that cont credits awarded whilst claiming IB are not applicable for claiming benefits, but they do go towards your pension entitlement

Hi H,

Those in receipt of IB based upon their own N.I. contributions are also credited
with a full N.I. contribution. I'm not really into JSA, but for other contributory benefits, it's the last 3 years that count.

To the best of my knowledge, an N.I. credit is the same as a full N.I. contribution, so see no reason why you shouldn't qualify for CB JSA.

thanks for replies im just concerned i will lose my ib and wondered what i might be able to claim i wont get income based as husband works

My reference to NI credits not counting towards benefit entitlement was based on my own experience of working in the DWP years back. However, think I'm still right. Paid NI contributions are classified differently to credited NI conts.

Benefit entitlement is based on PIE date which determines which tax years will be used to assess any benefit claim. PIE date for a direct transfer from IB to JSA should not change.

Hi

Thank you for replying to helchis, although your post was in triplicate, so I've deleted the other two. As I said neither I nor any other moderators deal with JSA. All I know was that when I took early retirement at 50, and being on IB for over 15 years due to MS. I received a full state pension when I reached 65 due to N.I. contributions and N.I. credits. Obviously the rules must be different for JSA, so apologies for any misinformation.

Here on B & W, our expertise is confined to DLA/AA and IB/ESA and Appeals so that's the only area on which we can give reliable advice as is explained in FAQ

We do have a moderator Crazydiamond who is a former Adjudication Officer for the former DSS, but he doesn't appear to be around at present, in fact it appears I'm the only moderator around today and my expertise is DLA/AA and IB and appeals and IIDB.

All moderators have either chronic illness or severe disability themselves, so that may be the reason why CD doesn't appear to be around, plus we are all volunteers and are only required to log in once a day.

I've been answering posts since 10.30 am, so I'll also be offline soon as I'm knackered.
