lost my dla was created by martha
i have had my dla stopped this week. after 10 years.
the decision maker said i can walk over 100 meters. i did not write this on my form i wrote 0 meters without severe discomfort. are they allowed to just change my information?
they did not contact my gp or specialist.
i am due to have another operation next month for my disabilty (reflex sympathetic dystrophy )after a head on rta. that will involve having the ligaments replaced in my leg, four months of plaster and a metal cadge drilled into my bones. i will not be able to walk, get upstairs to the toilet wash or dress myself. they told me to reapply when this happens, but wait three months first? (will my disability disappear for this period or is it that it is then i will need the care but wont be able to claim it?)
i am a nurse and work part time in a sedatory role due to my disability ,work have been very supportive and allow me to have time off for my treatment. i have to hand my motability car back, i cannot afford another on my wage, there is no public transport to the hospital from where i live 20 miles away, so i will probably lose my job now. i wont even be able to get to physio after my op. is this what the gov wants to attack the people who are elidgable? who do work and pay their way but need the dla for what it was originally set up for to provide independance and quality to life?it appears to be a false economy to me when i will now reapply for a higer rate next month. i am stressed and will be too ill to appeal(fight) properly.

Hi,

Decision Makers often get things wrong. My advice is to appeal, especially after you've been on DLA for 10 years.

As we cannot give advice on individual claims, you need 'face to face' advice from an organisation such as your local CAB, or contact Community Legal Advice

Also, check out our guides to DLA in the members only area HERE

Tribunals are independent of the DWP, and currently around 60% of DLA appeals are successful, so long as you opt for an oral hearing.

You can download an appeal form here Appeal against a benefit decision (leaflet GL24)

Good luck.

Jim
