i am still awaiting to hear of my tribunal date after it was adjourned last month my question is can i apply for job seekers benefit as im not currently getting any money or will this affect my tax credits? We just need a little more than tax credits coming in to keep our heads above water for a while

Hi,

You don't say what it is you are appealing against.

If it is ESA then you would usually continue to claim ESA at the assessment rate, but we wouldn't be able to offer any information about how this might affect other benefits, I'm afraid.

Hi sorry yes it is ESA but i have not received any money at all so far not even the assesment rate and this has been going on for a year now as you can imagine my debts have built up even more and our money has dwindled down even more

Hi,

We cannot advise on means-tested benefits since we would need to know lots of personal details which shouldn't be posted in a public forum which anyone can read, although only members can reply.

Your local CAB should be able to assist you, or you can call the Benefits Enquiry Line (BEL) free on 0800 882200 and ask them to do a benefits check for you.

You can claim ESA at the assessment rate until your appeal is decided. Furthermore, you should have been paid at the assessment rate as soon as you lodged an appeal against the adverse ESA decision.
