Question about work expectations if you fail

Can anyone please help with this query as it is potentially very worrying? (I think it has been overlooked due to the large number of posts in the last few days) Thanks

I don't have the answer to this question but my guess is that you make a new application for ESA & get as much supporting evidence from GP,consultant & any other health or welfare professional you have contact. If you haven't asked for a copy of the medical report & the DWP's decision/score sheet you need to do so & you will see where you scored & didn't score points so can present your evidence accordingly. Hope someone can come up with a more definitive answer.

As of May 09, the JSA situation was as follows:-

When you start a claim for JSA you will be interviewed by an Adviser who will assess your eligibility. To receive JSA you must be available for at least 40 hours a week, unless you have caring responsibilities, physical and/or mental disabilities. If you are a carer or have a disability and providing the restrictions are reasonable, you can restrict your availability (eg hours, travel time, type of work). Ask to be referred to a Disability Adviser. You must also agree to actively seeking work. If you are eligible, the Adviser will go through your Jobseekers agreement with you (JSAg). Before signing this document, read it and ensure that you make them aware of your illness/disability and that the Adviser records the days, hours agreed on the JSAg before you sign it.

Benefit is stopped if you fail to actively seek work or refuse employment. If you are left without benefit you should be given information and a form to apply for a crisis loan.

I think i am right but i am sure someone will tell me if i am not but i dont think you can claim ESA for another 6 months if you have been found fit for work at the medical.
