UC Migration help regarding caring for someone

Hi, we are on a couples Income related ESA, we also receive the severe disability premium [£165.80] as a couple [husband in support group & PIP and wife on standard care pip], my wife is also an appointee for my adult son [over 30 years old and in ESA support group and PIP], I have a few questions; -

1. As we are awarded SDP because we don’t claim carers allowance would SDP still be awarded if my wife cared for me [or son] for more than 35 hours even though she doesn’t get a carers allowance or would the SDP only stop if she claimed carers allowance?

2. If she did care for me [or son] for 35 hours or more would this exempt her from attending looking for work with a work coach or would the exemption only apply if she was actually claiming a carers allowance?

3. as my wife is an appointee for my son would this alone exempt her from attending looking for work with a work coach regardless of caring for more or less than 35 hours?

Thank you very much for any help or advice in working through the Migration process

1. You won't get the SDP if your wife get's carer's allowance for you. But she can get if for your son.
2. If she cared for you officially under UC then she would not have to look for work.
3. No Appointees have to look for work if required just like anyone else.

Hi David, In 2. If she cared for you officially under UC then she would not have to look for work. In this situation would the care have to be more than 35 hours a week to apply or can it be lower?, Thank you

Here are the rules regarding the UC Carer's Element--

Carer's Element
This element is £201.68 per month.

You can get this element if you are providing care for at least 35 hours per week for someone who gets:

Attendance Allowance, or
Pension Age Disability Payment (Scotland), or
The highest or middle rate care component of Disability Living Allowance or Child Disability Payment, or
Daily living component of Personal Independence Payment, or
Armed Forces Independences Payment, or
Constant Attendance Allowance of £90.20 per week paid with Industrial Injuries Benefit or War Disablement Pension.
You do not have to claim Carer's Allowance to get this element.

Unlike Carer's Allowance or Carer Support Payment (Scotland) where you are prevented from claiming if you are earning above a certain level (£196 per week for 2025/26), for the Carer's Element your level of earnings does not prevent you from claiming. However, as the Carer's Element is a part of Universal Credit (UC), which is means tested, your earnings and other income will affect how much Universal Credit overall you are entitled to.

If you are making a joint claim, you can get a Carer's Element each if you both qualify for it. However, you cannot be caring for the same person.

Getting the Carer’s Element of Universal Credit might affect the benefits of the person you care for. It might mean they lose their entitlement to the Severe Disability Premium (SDP).

Hi David and friends, we have submitted the online Universal credit application in but have a few questions: -

1. On my wife’s to do list it says: prepare to meet your work coach, she is an appointee for my son but nowhere on the form could we see anyware to add this, we have contacted the DWP and they are sending out a BF57 to confirm that my wife is an appointee for my son, so do you know how to explain this to someone regarding this and just to clarify as an appointee she won’t need to prepare to meet a work coach or look for work ?

2. now on looking at the new claim submitted it says my wife doesn’t care for anyone even though she put down yes to caring for son and husband, is this not shown as caring for someone because she spends less than 35 hours a week caring?

3. The only other thing is it says for both of us prepare to attend your Biographical appointment by phone, I think this is to proof who we are, is this straightforward or do we need anything with us when they ring and is this a good opportunity to explain my wife is an appointee?

4. last on to do list is answer a few equality questions

To answer your questions--
1. Unfortunately Appointees can be asked to look for work. When the Work Coach phones you can ask them to check that you wife's name has been entered in CIS Searchlight under the Relationships tab as the Appointee. If not this will cause future problems.

2 You have not read my previous post. It needs to be 35 hours per week or more.

3. and 4. The questions you will be asked are sourced from Benefits information held on CIS Searchlight. The questions are usually quite simple.
